Privacy Policy Notice

This Privacy Policy Notice (this “Notice” or this “Policy”) describes how GTK Marketing, LLC d/b/a Athletic Edge Official and our affiliated entities and assets (“Athletic Edge,” “we,” “us,” or “our”) process personal information in relation to your use of our proprietary mobile and desktop software-as-a-service platforms (“Platforms”) or your participation in an event, tournament, combine, league, race, regatta, competition, camp or recruiting activity (“Events”) hosted, managed, or serviced by us. 

We provide mobile and desktop software applications for, among other things, sports registration, team/league/association management, payments, fundraising, registration protection, event planning and production, tournaments, travel and recruiting, scorekeeping and team management, and applications for communication, scheduling, and content management. Depending on where you live and what you are doing on our Platforms, certain specific provisions of this Notice may apply to you. 

This Notice is intended to facilitate our unified approach to complying with varying privacy laws of different U.S. states by integrating state-specific provisions under which we may be deemed to be a “Business” or a “Controller,” including the requirements of: the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), the Delaware Personal Data Privacy Act (DEPDPA), the Iowa Consumer Data Protection Act (IACDPA), the Minnesota Consumer Data Privacy Act (MNCDPA), the Montana Consumer Data Privacy Act (MTCDPA), the Nebraska Data Privacy Act (NEDPA), the New Hampshire Data Privacy Act (NHDPA), the New Jersey Data Privacy Act (NJDPA), the Oregon Consumer Privacy Act (OCPA), the Tennessee Information Protection Act (TIPA), the Texas Data Privacy and Security Act (TDPSA), the Utah Consumer Privacy Act (UCPA), and the Virginia Consumer Data Protection Act (VCDPA). 

We are required to furnish data subjects with a compliant privacy notice as outlined in each applicable state’s privacy law. 

 

Policy Scope; Consent 

We are committed to protecting your privacy in accordance with the terms of this Notice. This Notice describes how we collect, use, share, and protect your personal information. It applies to the collection by Athletic Edge of information on our services, applications, websites, and tools (collectively, our “Services”). 

Please note that we integrate with and provide many of our Services to organizations that have their own separate privacy practices, which may also govern your data in different ways. When we work on behalf of other organizations, we function as a Processor in accordance with our contract and manage your data on their behalf or at their direction. For certain purposes (e.g., when you contract directly with us for our owned-and-operated camps, events, recruiting services, or official scheduling/payment services) we may handle your data as a Controller; for others (e.g., when we facilitate choices made by a club, association, league, camp, or player development program), we may act as a Processor. This Privacy Notice applies only to our data practices, and not to the practices of organizations and third parties we do not control. 

Your consent 

By using our Services, you agree to the terms of this Notice. You should read this Notice carefully to understand our privacy practices. By accessing, browsing, downloading, or otherwise using the Services, you confirm that you have read, understood, and agreed with this Notice. 

In addition, by using our Services, you also agree to our Terms of Service (https://athleticedgeofficial.co/terms). If you do not agree to this Notice and the Terms of Service, you may not use the Services. This Notice applies regardless of how the Services are accessed and covers any technologies or devices by which we make the Services available to you. 

From time to time, we may provide additional privacy notices where appropriate. Please read this Notice together with any other privacy notice or terms we may provide on specific occasions, so that you are fully aware of how and why we are using your data. Purpose of this Notice; Certain Definitions 

This Notice identifies our practices concerning the collection of certain personal information from you, the purposes of that collection, the sources from which we collect such information, and the measures we use to protect your personal information. 

  • Personal information or personal data means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. 
  • Business/Controller means a legal entity that collects personal information on its own or by others on its behalf and that alone or jointly with others determines the purposes and means of processing. 
  • Processor means a legal entity that processes personal data on behalf of a Controller. 
  • Processing means any operation performed on personal data, such as collection, use, storage, disclosure, analysis, deletion, or modification. 

 

Information We Collect 

Personal information you provide directly to us 

For certain activities—such as registering for or subscribing to our Services, downloading content, or contacting us—we may collect some or all of the following categories: 

  • Registration and profile information (e.g., username, first and last name, birth date, phone number, email address, and other identifying information), including when you create an Athletic Edge account, participate in an Event, respond to a survey/ballot/promotion/contest, or correspond with us. 
  • Payment and billing information if you sign up for fee-bearing Services. 
  • Athlete and recruiting information when you sign up for Events or recruiting Platforms, which may include height, weight, high school name/location, graduation year, athletic performance and statistics, photos/videos (e.g., event or game footage or interviews), academic information (e.g., GPA or SAT/ACT), college offers, citizenship, interest in military programs, social media username, and parent/coach contact details, as relevant to athlete development or recruiting. Athletes may be requested or required to provide additional similar information to register for an Event. 

Data collected through your use of the Services 

After you set up your account, you may provide additional information shared through a public profile (“Profile Information”), such as height, weight, gender, interests, friends/contacts/referrals, photos/videos, academic accomplishments, biographical or biometric data, and team/league information. This may be provided by you or by a third party (parent, coach, team manager, club, league, association, college coach, tournament director). We also collect information about how you use the Services, how you input data, and the data you input. 

Contact Information 

Athletic Edge may collect information from an address book or stored contact list that a user uploads or otherwise provides. Certain Services permit organizers/coaches to upload athlete information; where an athlete (or parent) is not already a member, we may send an invitation to join. Certain Services permit coaches to adjust such messaging in settings. 

Information we collect from third parties 

We may collect information about you from publicly available sources or other third parties, including event schedules, player statistics, race times, and roster information. We may receive information about you and your friends when you interact with our sites through social media (e.g., liking/following/connecting). Data received depends on your social network settings. 

Monitoring user activity 

We may, at our discretion, monitor communications on certain Services (e.g., messaging) to protect users and monitor effectiveness. You acknowledge that you have no expectation of privacy with respect to such communications/postings and you expressly consent to such monitoring. 

Personal information we collect automatically 

When you use our websites, Platforms, Services, or applications, we may automatically collect: 

  • Device information (IP address, browser types/language, OS, platform, device type/IDs/advertising identifiers). 
  • Usage information (files downloaded, domain names, landing pages, browsing activity, clicks, scrolling/keystroke activity, pages viewed, ads viewed/visited, forms or fields you complete/partially complete, search terms, email opens/interactions, access times, error logs). 
  • Location information (city, state, ZIP via IP; Wi-Fi triangulation; precise GPS from mobile apps with your consent). 
  • Viewing behavior (content viewed, duration, quality metrics like buffering/load times, ad interactions). 
  • Offline information stored while offline and transmitted when you reconnect. 

Credit Card Information 

We collect payment card information at the time of transaction to complete purchases (e.g., Services, merchandise, registration insurance, camps, events). We do not store payment card information on our servers or platform. It is sent securely to a trusted third-party payment processor. 

NOTICE to California Residents: As outlined in CCPA/CPRA, Athletic Edge may have collected in the previous 12 months the following categories: (A) Identifiers; (B) Personal Information; (C) Protected Classification Characteristics; (D) Commercial Information; (E) Biometric Information; (F) Internet or similar network activity; (G) Geolocation Data. 

 

Data Use 

We may use, share, sell (as defined broadly under certain state laws), or otherwise disclose personal information for one or more of the following purposes: 

  • To fulfill or meet the reason for which the personal information is collected. 
  • To provide you and other users with email or SMS alerts and other notices concerning our Services. 
  • To improve our Services for you and other users. 
  • For testing, research, analysis, and product development. 
  • As necessary or appropriate to protect the rights, property, or safety of us, our clients, or others. 
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations. 
  • As described at the time of collection or as otherwise set forth in applicable state privacy laws (e.g., CCPA/CPRA, CPA, CTDPA, DEPDPA, IACDPA, MNCDPA, MTCDPA, NEDPA, NHDPA, NJDPA, OCPA, TIPA, TDPSA, UCPA, VCDPA). 
  • To evaluate or conduct a merger, divestiture, restructuring, financing/refinancing, reorganization, dissolution, or other sale/transfer of assets, including bankruptcy or similar proceedings. 

We will not collect additional categories of personal information or use personal information for materially different, unrelated, or incompatible purposes without notice. 

 

Data Sharing 

We may share your personal information in the instances described below. See Your Choices About Your Information for managing certain preferences. 

Without separate or additional notice, we may disclose your personal information to hosting partners, affiliates, service providers, contractors, and other parties who assist or support us in: (i) operating our Platforms and providing our Services (including outsourced hosting); and (ii) conducting business related to the Services (e.g., payment processing, data storage). We may also contract with trusted third parties to provide complementary products or services integrated or interfaced with our Platform; such parties may require access to personal information to provide those services. These parties are required to use your personal information solely to perform tasks for us and to keep it confidential under obligations similar to those in this Notice. 

In the event of a sale or other change of control, the terms, rights, and practices described in this Notice may transfer to the new owner. We may provide your personal information to the purchaser so you may continue the relationship or business with our Services. 

We may release your personal information to comply with the law, enforce our policies, or protect rights, property, or safety (including using trusted third parties to assist investigations into fraudulent or improper use). 

Certain Services (e.g., recruiting or social/photo features) allow you to connect with others and share information. Your public-facing profile and related information may be available publicly and searchable via search engines. You may be able to adjust profile settings to limit public visibility, though information may remain visible to other users. 

Our registration and club/league/team/association tools may use or share information to fulfill orders (e.g., uniforms, gear/fanwear/apparel) or enhance participation. We may share information with third-party fulfillment partners and representatives of organizations you register with (e.g., coaches, league officials, race/camp/combine organizers, athletic departments). Those representatives may share information consistent with their own privacy practices, which we do not control. 

We may also share your personal information with: 

  • Other companies owned by or under common ownership with Athletic Edge. 
  • Third-party vendors/service providers performing services on our behalf (e.g., advertising, billing, payment processing, fulfillment, research/analytics, hosting, fraud prevention, identity management, conversion services). 
  • Trusted business partners who may contact you about opportunities that may interest you. 
  • Other users of Services that involve searchable profiles or roster-based access (e.g., recruiting). 
  • Colleges and universities (directly or via a third party) you indicate interest in, as well as other accredited institutions that may be relevant. 
  • The public (for content you voluntarily disclose). 
  • Other parties in connection with corporate transactions. 
  • Third parties for personalization using hashed or masked identifiers. 
  • Third parties as required by law or to protect rights/security. 
  • Any party for aggregated, anonymized, hashed, or de-identified data. 

SMS consent: We will not share your phone number(s) with unaffiliated third parties for their own marketing. Your consent for us to collect your phone number(s) and communicate via SMS/text is not consent for unaffiliated third parties to contact you by those means for marketing/promotions. 

 

Data Security Measures 

Athletic Edge cares about the security of your information and uses commercially reasonable physical, administrative, and technological safeguards. 

Our measures include, as appropriate: 

  • Comprehensive data security policies and procedures 
  • Data minimization 
  • Secure connection technologies (e.g., SSL/TLS) beyond internal networks 
  • Data destruction when no longer needed 
  • Regular risk assessments and risk treatment 
  • Employee screening and confidentiality agreements 
  • Security awareness training 
  • Encryption of laptops and portable media 
  • Intrusion prevention/detection monitoring 
  • Network segmentation 
  • Patch management and safeguard maintenance 
  • Vendor onboarding due diligence and periodic reviews 
  • Physical security controls 

Please note: No security system is impenetrable. In the event information under our control is compromised due to a security breach, we will take reasonable steps to investigate and, where appropriate, notify affected individuals, consistent with applicable law. 

 

Cookies and Tracking 

Our websites use tags, log files, web beacons, and similar trackers from us and third parties (“Cookies”). Cookies are small data files stored on your device that help improve Services and your experience. Web beacons are clear electronic images used to deliver cookies, count visits, understand usage/campaign effectiveness, and determine if an email has been opened/acted upon. 

We may send cookies to your browser to identify it, help you log in faster, and enhance navigation. Cookies may convey information about how you use the Services and allow tracking over time. We may collect log file information each time you access a Service (e.g., web request, IP address, browser type, device info, referring/exit pages and URLs, clicks, link interactions, domain names, landing pages, pages viewed). We may employ clear gifs in HTML-based emails to track opens and link clicks. We may use analytics tools to measure traffic/usage and to create profiles for advertising, marketing, and analytics. 

Managing cookies: Most browsers allow you to (i) receive cookie notifications, (ii) disable existing cookies, or (iii) block cookies. Some features may not work with cookies disabled. Email settings can prevent automatic image downloads. 

We are not able to respond to Do Not Track signals at this time. 

Mobile identifiers and location: When you access the Services via mobile, we may receive unique device IDs, carrier, device type/model/OS, phone number, and—depending on your settings—geolocation (including GPS). Uploaded images may contain metadata (e.g., location). 

We may use collected data to: (a) remember info so you won’t have to re-enter it; (b) provide personalized content/ads; (c) provide/monitor Service effectiveness; (d) monitor aggregate metrics; (e) diagnose/fix technology problems; and (f) plan and enhance Services. 

We may permit third-party ad networks, social media companies, and other services to collect browsing behavior using cookies, plug-ins, or other tracking technology for interest-based advertising. Depending on your device, controls may be limited. 

By visiting our Services, you consent to our and third parties’ use of tracking technologies as described. 

Types of Cookies 

Purpose 

Strictly Necessary 

Essential for site functionality (e.g., privacy preferences, login, forms). You can block them, but the site may not work properly. These do not store personally identifiable information. 

Performance 

Allow us to count visits/traffic sources to measure and improve performance. All data is aggregated/anonymous. Disallowing these limits performance monitoring. 

Targeting 

Set by advertising partners to build a profile of interests and show relevant ads on other sites. Do not store direct personal info but rely on unique identifiers. Disallowing reduces targeted advertising. 

 

Your Right to Review and Correct Data 

Access to certain account-specific personal information collected from our Services may be available for your review (e.g., via your password-protected account). You may also email or mail us to request access or correction. Include your registration information (first name, last name, email) in the request. We may require additional information to verify your identity. See Contact Us for our address and email. 

 

Protection of Children’s Data 

OUR PLATFORMS ARE INTENDED TO ENABLE PARENTS AND OTHER ADULTS TO REGISTER AND MANAGE THEIR OWN AND THEIR CHILDREN’S PARTICIPATION IN SPORTS-RELATED ACTIVITIES. IF YOU WISH TO PROVIDE YOUR CHILD WITH DIRECT ACCESS, PLEASE READ THIS CHILDREN’S PRIVACY POLICY CAREFULLY BEFORE ALLOWING YOUR CHILD TO USE ANY ATHLETIC EDGE SERVICES. 

The Children’s Online Privacy Protection Act (COPPA) requires that we inform parents/guardians about how we collect, use, and disclose personal information from children under 13. Certain states impose additional requirements (e.g., Oregon minors under 16; Connecticut, Delaware, Minnesota, Montana, Nebraska, New Hampshire, and New Jersey minors under 18). 

  • “Parent” includes legal guardians. 
  • “Child” means: under COPPA and certain state laws, a child under 13; Oregon minor under 16; Connecticut, Delaware, Minnesota, Montana, Nebraska, New Hampshire, New Jersey minors under 18. 
  • “Personal Information”/“Profile Information” includes identifiers (e.g., name, birthdate, contact info) and, depending on Service, player profile details (height, weight, photo/video, biographical data, team/league data). For Services that process payments to you or your child, additional info (e.g., account or tax information) may be required. 
  • “Organization” means the club/league/team/school or other organization using our products to operate its site and services. 
  • “Service” means the services offered by Athletic Edge through our websites, applications, and tools. 

This section describes how we collect, use, and disclose personal information about Children when a Parent subscribes on a Child’s behalf. It incorporates our Terms of Service: https://athleticedgeofficial.co/terms 

Consent: Children under 13 (or Oregon minors under 16; CT/DE/MN/MT/NE/NH/NJ minors under 18) may use applicable features only with verifiable parental consent. We obtain consent by: (1) parent registration and payment (e.g., for a team, camp, or subscription); and/or (2) parent acceptance of an emailed invitation confirming intent and purpose. 

Parental tools: Parents can edit their Child’s profile, adjust notifications, and monitor postings/interactions. Parents should closely supervise their Children’s use of the Services. 

Tracking: When a Child is logged in, we may track pages visited, time logged in, preferences, and comments. We do not share a Child’s personally identifiable information with advertising partners. Some third parties may use tracking technologies subject to their own privacy policies. 

Parental requests: Parents may request information on data collected about their Child, view it, prohibit further use, or request deletion. See How To Review, Delete or Alter below. 

How To Review, Delete or Alter Your Child’s Information: Log in to review or manage the account/profile, or email us at contactus@athleticedgeofficial.co. Note that content may remain viewable in cached/archived pages or where others have copied or stored it. 

Changes to Children’s Policy: We may amend this policy and will post the effective date. If we intend to use or disclose a Child’s information materially differently, we will notify the Parent via email and obtain consent.

Because the platform encourages sharing recruiting/development information, deletion of certain information may affect the functionality of certain Services.

Your Choices About Your Information 

  • Access/Correction: You can access, correct, and update certain personal information via Edit Profile and Account Settings on our Platforms. 
  • Communications preferences: Update your preferences in your account settings. You can stop promotional emails via the “unsubscribe” link and stop promotional texts by following the opt-out instructions (e.g., replying STOP). We may still send Service-related communications (e.g., verification, billing, feature updates, technical/security notices). For some Services (e.g., recruiting), coaches/organizations may contact you through or outside the Service. 
  • Texting for coaches: Certain Services may allow coaches to text athletes on their rosters if they have appropriate consent. 
  • Privacy settings: Subject to available settings, information you make public may be searchable/viewable by others and via APIs/search engines. Changing settings won’t retroactively affect previously shared information. 
  • Retention: Following termination/deactivation, we may retain profile information for a commercially reasonable time for backup, archival, or audit purposes. Contact contactus@athleticedgeofficial.co to request deletion. Some data cannot be removed (e.g., content others have copied, or data added by coaches/organizers to rosters or lists). 

Authorized Agents: We will recognize an authorized agent if we can verify your identity and the agent’s authority to act for you. Certain actions may limit features or access. 

 

Changes to this Notice 

This Notice is effective as of the date above. We may change this Notice at any time. We will take reasonable steps to advise you of material changes (including obtaining your acknowledgement where required by law) or by posting the revised Notice on our website.
